terms of service

These Terms of Service ("Terms") govern your use of imghost, an image hosting service operated as part of imgto64.co.uk ("we", "us", "the service"). By creating an account or using the service, you agree to these Terms. If you don't agree, please don't use the service.

1. eligibility

You must be at least 13 years old to use this service. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.

2. your account

• You're responsible for keeping your login credentials secure.
• You're responsible for all activity that happens under your account.
• You may sign up using email/password, or via Discord, GitHub, or X.
• Let us know immediately if you believe your account has been compromised.

3. acceptable use

You agree not to use imghost to upload, host, or share content that:

• Is illegal under the laws of England and Wales or the jurisdiction you're accessing the service from
• Depicts or facilitates child sexual abuse material (CSAM) — this is reported to the relevant authorities (including the IWF and/or NCMEC) and your account will be immediately and permanently terminated
• Infringes someone else's copyright, trademark, or other intellectual property rights
• Contains malware, exploits, or content designed to harm other users or systems
• Harasses, threatens, or incites violence against any person or group
• Violates the privacy of others, including non-consensual intimate imagery
• Is used for spam, phishing, or fraudulent purposes

We reserve the right to remove any content and suspend or terminate accounts that violate these Terms, without notice, at our discretion.

4. your content

• You retain ownership of any images you upload.
• By uploading content, you grant us a limited licence to store, host, and serve that content back to you and to anyone you share the link with, solely for the purpose of operating the service.
• You confirm you have the right to upload and share any content you put on the service.
• You're solely responsible for the content you upload and any consequences of sharing it publicly.

5. public links

Images you upload are assigned a public URL, which may use a custom slug you choose. Anyone with that link can view the image — there is no built-in access control beyond the link itself. Don't upload anything you don't want potentially accessible to others. We are not responsible for content accessed via links you've shared or that have been guessed by third parties.

6. custom slugs

Custom URL slugs are allocated on a first-come, first-served basis. We reserve the right to reclaim, disable, or reject slugs that are offensive, infringe trademarks, impersonate others, or otherwise violate these Terms.

7. storage limits & service availability

We may impose limits on file size, storage quotas, or account activity at our discretion, with or without notice, to keep the service running smoothly for everyone. We aim for high availability but don't guarantee the service will be uninterrupted, error-free, or available at all times. We may suspend the service for maintenance, or discontinue it entirely, with reasonable notice where possible.

8. account & content removal

You can delete individual images or your entire image library at any time via the Settings page. We may suspend or terminate your account if you breach these Terms. Upon termination, we may delete your stored content, though we're not obligated to retain or return it.

9. intellectual property

The imghost name, design, and underlying software are our property or used under licence. These Terms don't grant you any rights to our branding, code, or trademarks beyond using the service as intended.

10. disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that uploaded content will be preserved indefinitely or that the service will be free of bugs or downtime.

11. limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including loss of data, loss of profits, or reputational harm. Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, where such limitation would be unlawful under UK law.

12. indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the service or your breach of these Terms, including content you upload that infringes third-party rights or breaks the law.

13. changes to these terms

We may update these Terms from time to time. We'll update the "last updated" date above when we do. Continuing to use the service after changes are posted means you accept the revised Terms.

14. governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the service will be subject to the exclusive jurisdiction of the courts of England and Wales.
